Neck Pain Compensation Case Study 1
SITUATION: Mr Bright was
employed as a delivery driver by a food distribution company. He was
injured when a cage containing boxes of fruit and vegetables fell from a lorry while it was being unloaded. The cage hit Mr Bright
onto his head and neck. Mr Bright was taken to hospital on
the day of the incident but was discharged the same day and advised to take
pain killers and not to drive for two days. His neck was very painful
and his sleep was affected.
RESULT: Mr Bright was off work for two
weeks. Mr Bright's employer admitted that they were to blame for the
incident as the tailgate on the lorry was defective. Bartletts
Solicitors arranged for Mr Bright to be examined by a Consultant
Orthopaedic Surgeon and for a report to be prepared on his injuries.
The expert found that Mr Bright had suffered a soft tissue injury to
his neck because of the cage that had fallen onto him. Mr Bright
received £5000 in compensation after Bartletts Solicitors had
negotiated settlement with his employer.
