At Bartletts, we can represent you under the terms of a 'No win, No fee' agreement, which is also called a 'Conditional Fee Agreement' (CFA). By entering into this agreement with us you pay nothing win or lose. In addition not one penny is taken out of the compensation we obtain for you!
Unfortunately, legal aid is no longer available for personal injury cases, so we need a way to represent you which does not require you to pay us our fees, but to enable us to act on your behalf and obtain compensation for you.
The 'No win, No fee' regime was introduced to ensure that victims of accidents could have access to justice regardless of whether they could afford to pay legal fees. Provided that you act in accordance with our instructions and do not breach the conditions of the 'No win, No fee agreement', there will be nothing to pay, whether you win or lose your claim.
Before we sign the 'No win, No fee' agreement, we have a duty to ensure that you have no other method of funding your claim. So we will ask you and investigate whether there are any alternative methods of funding. They could be:
Legal Expense Insurance which could be attached to
any existing household or motor insurance that you may have.
Legal Expense Insurance with a credit card/bank.
Union membership, it is a term of your membership that your union will
provide you with access to free legal advice.
A stand alone Legal Expense Insurance Policy.
When we act for you under a 'No win, No fee' agreement, we do not require you to pay upfront. If your case is not successful, we will terminate the agreement at no cost to you (as long as you have not breached the agreement, ie, by deliberately misleading us).
If your claim is successful, your opponent pays your legal costs and a success fee. The success fee is an additional amount of costs that are paid to reflect the risk that we have to abandon some claims without getting paid at all.
What is important to you is that you get to keep 100% of your compensation and there are no deductions.
