    SITUATION: Mr Ellis worked for the local council. His job was working for the Highways Department as a flagger/labourer. During his employment he would be responsible for the laying of paving slabs, concreting and tarmacking. He used vibrating tools such as jack hammers, wizzers and wackers. He was provided with safety training and gloves. However, there was no job rotation so he did not have a break from the vibrations and he would frequently find himself using vibrating equipment for most of the day, save for travelling time. Also, there was a bonus scheme in place so Mr Ellis was encouraged to work as hard as possible to achieve his bonus, thereby increasing his exposure time on the vibrating work equipment. His employer did not carry out routine health surveillance for the first 10 years of Mr Ellis's employment.

    RESULT: Mr Ellis started to notice a tingling in his fingers when he was using the vibrating equipment. He found that his fingers became painful, especially in the cold weather. He noticed a loss of grip strength. Following health surveillance by his employer which revealed that he had the condition called vibration white finger, Mr Ellis was redeployed to the position of gatekeeper. He no longer used vibrating work equipment, but the damage had already been done. He continued to suffer and instructed us to deal with his claim.
