Soft Tissue Injury Compensation Awards
Compensation awards for damage to soft tissues will reflect the extent and repercussions of the injury. For moderate whiplash, awards will range from £8,750 to £16,000. With minor soft tissue damage awards will be between £850 and £5,000, depending on the recovery time. A soft tissue injury to the back, where ligaments and muscles have been disturbed and backache or disability of some form are involved, compensation awards will range from £8,000 to £17,750. For similar injuries where a full recovery is made within 5 years, awards will be between £5,000 to £8,000. Awards for soft tissue injuries to the shoulder will reflect the recovery time, and vary between £2,750 and £5,000. Soft tissue injuries to the wrists, necessitating bandages but from which a full recovery is made will be in the same bracket, but could rise to £6,500. Moderate soft tissue injuries to the hands or thumbs will result in compensation ranging from £4,000 to £8,500, where a permanent disability remains. Soft tissue injuries to the legs will lead to compensation awards of up to £5,750.
Soft Tissue Injury Compensation Case Study 1
SITUATION: Mr Adams was required
to fit a beam in the course of his building work, by using a ladder.
Whilst working on the beam,
the ladder slipped causing Mr Adams to fall. Mr Adams sustained a soft
tissue injuries to his legs and back, as well as permanent scarring to
his right shin.
RESULT: Mr Adams' employers initially
denied liability. We did not accept their denial and continued to press
them for an admission of liability. Mr Adams' employers then accepted
primary liability but alleged Mr Adams was partly to blame. We did not
accept this and ultimately settled Mr Adams' claim on a 100% basis in
his favour. Mr Adams received £3,700 in relation to his
injuries.
Soft Tissue Injury Compensation Case Study 2
SITUATION: Mr Patel suffered a soft
tissue injury to his back as he was having to move a large number of
tyres on and off a lorry every day. Manual handling training had not
been provided by Mr Patel's employers and nor had they provided a tail
lift to the vehicle Mr Patel was expected to use.
RESULT: Mr Patel's employers initially
denied liability and sought to argue that moving the tyres would not
cause any injury and that a tail lift was not required. We refused to
accept this and obtained the necessary medical evidence on behalf of Mr
Patel, ultimately recovering over £18,000 compensation for
him. Bartletts fees were paid by Mr Patel's employer, and he kept 100% of the compensation.
