Accidents Due To Fatigue Compensation Awards


Fatigue often causes road traffic and other vehicle accidents, where the driver and passengers may suffer whiplash. A case of whiplash or similar 'wrenching' injury where movement is limited and pain is permanent or recurring, compensation awards will be between £8,750 and £16,000. A minor whiplash injury where a full recovery is made within year will results in awards of between £850 and £2,750. Machine operators and production line workers are at risk of accidents due to fatigue, especially if they work at night. A 'crush' injury to one hand may require surgical amputation. Compensation for the loss of a hand will be between £61,500 and £70,000. A severe fracture to the fingers, leading to permanent loss of sensation and / or grip will result in awards of up to £23,500. Burn injuries may result in scarring to any part of the body, and awards generally fall into the £4,750 to £9,000 bracket for a number of noticeable, or a single disfiguring scar. Awards for severe facial scarring however may reach £42,000 for men, and £62,000 for women.



Injury Caused By Fatigue Compensation Case Study 1


SITUATION: Mr Fitzpatrick received £4,000 compensation when he dropped a detachable piece of machinery on himself whilst at work and broke two of his toes. He had worked extensive shifts of more than 8 hours at night, and his working conditions were unsatisfactorily lit. Mr Fitzpatrick was off work for 3 weeks.

RESULT: He decided that, because he was only receiving Statutory Sick Pay, that he would bring a claim and he contacted Bartletts Solicitors who allocated his claim to a specialist personal injury solicitor at no cost to him. An interim payment for Loss of Earnings was obtained after 5 months of Mr Fitzpatrick starting his claim. Within 10 months of starting his claim, it had been settled and Mr Fitzpatrick received his compensation.



Injury Caused By Fatigue Compensation Case Study 2


SITUATION: Mr Williams was walking into his place of work when another member of staff driving a fork lift truck collided into him. The fork lift driver had been working long hours and claimed to be over tired at the time. Mr Williams sustained a soft tissue injury to his chest lasting 3 months and was unable to work for 3 weeks following the accident. He received no pay during this time and so instructed Bartletts Solicitors to pursue a claim.

RESULT: Mr Williams' employers were found to be negligent for the accident. Mr Williams' claim settled within 6 months and he did not have to attend Court. Mr Williams was able to claim back his lost earnings and received 100% of his compensation in the sum of £2,325.
