Case Study: Slip On Spilled Liquid
Situation: Mrs Trevor was visiting a Tesco store with her two children. As she was walking up one of the aisles she slipped on a patch of spilled fruit juice, and fell heavily, injuring her ankle and knee. Mrs Trevor was in considerable distress, and as she could not walk without assistance an ambulance was called and she was transferred to her local hospital. Following an X-ray, the doctors found that she had a badly sprained ankle, and had also torn ligaments in her knee. She was required to stay in hospital overnight and was taken home by her husband the next day. She was unable to return to work for 2 weeks, and was also forced to miss her cousin's wedding party a few days later.
Result: Mrs Trevor contacted Bartletts Solicitors for advice on bringing a compensation claim against Tesco. Mrs Trevor asked; am I entitled to claim against Tesco for my accident? We advised Mrs Trevor to proceed with a claim for negligence against the supermarket, based on the fact that staff and management had failed in their duty of care to her by not cleaning up the spilled fruit juice within a reasonable time-frame. The case was settled out of court following correspondence between Bartletts Solicitors and Tesco's insurance company. Mrs Trevor was awarded £5,250 in general damages, and another £1,500 in special damages reflecting time off work and medical expenses. The case was handled on a No Win No Fee basis, and as such Mrs Trevor kept 100% of her damages, with no deductions.
Case Study: Struck By Can Falling From Shelf
Situation: Mrs Percy was doing the weekly shopping in a Tesco supermarket with her eight year old child. As she was removing a can of produce from one of the shelves, a larger can fell from a shelf above it, striking her son on the forehead. A cut was immediately opened, and both Mrs Percy and her son became hysterical as blood poured from the wound. Staff at the supermarket were immediately summoned by fellow-shoppers, and the child received basic medical attention at the scene. He was subsequently transferred to hospital where stitches were applied, and was required to stay in hospital overnight for observation. Mrs Percy's son was forced to miss school for a period, and was left with a very noticeable scar on his forehead.
Result: The same day Mrs Percy contacted our specialist Tesco child accident solicitor and asked; how can I claim compensation against Tesco?
