Case Study - Mr Hands

Mr Hands was travelling in a taxi on his way to the airport, when he was involved in a road traffic accident and was injured. At the time, the driver of the taxi was having an argument with his taxi office controller over the phone, and was also driving too fast. He failed to see a car that had stopped at a pedestrian junction, and crashed into it. The seat belt in the back of the cab was not working properly, and Mr Hands was therefore not wearing one. He was thrown forward in the accident, banging his head against the back of the seat in front, and wrenching muscles in his neck, shoulders and upper back. The taxi driver was uninjured, and called an ambulance, which took Mr Hands to hospital, where he was diagnosed with whiplash and mild concussion. He continued to suffer from pain, tenderness and lack of mobility for over a month following the accident, and was forced to take 2 weeks off work, for which he was not paid.

We wrote to the taxi company’s owners, arguing that just prior to the accident, the driver had obviously been distracted while arguing with his office controller, and this lack of concentration had caused him to brake too late, and collide with the car that was stationary at the pedestrian junction. The taxi driver admitted that he had been at fault over the incident, and the fact that the seat belt was not operating properly, meant that the taxi company was also at fault for poor maintenance of the vehicle.
