Mrs Samuel was browsing the fruit aisle in her local supermarket, when she lost her balance and fell awkwardly, injuring her hip. Another customer had spilled some blueberries on the floor, and this was what caused Mrs Samuel to slip and fall. Mrs Samuel suffered a bruised hip, and had to call her son to come and pick her up. Before driving his mother home, Mr Samuel filed an accident report on her behalf with the supermarket supervisor, and took the contact details of a witness to the accident. While Mrs Samuel was not badly hurt, she was still experiencing pain and discomfort in her hip a week later, and had seen her GP for a check up.

We contacted them, referencing the accident report, and a statement from the shopper who had witnessed the accident. The supermarket had a legal responsibility to provide safe premises for its visitors, and the spilled blueberries should have been spotted and cleared up within a reasonable time-frame. There was a failure in the supermarket’s system of work in terms of cleaning and inspection therefore. The supermarket eventually accepted liability, and Mrs Samuel received £2,250 in compensation.
