Customer Sues Bank For Slipping On Wet Floor
Case Study - Ms Wilson
Ms Wilson was visiting the bank with her daughter, when she slipped and fell near to the entrance to the branch. Ms Wilson landed awkwardly, badly spraining her wrist, and dislocating two fingers. It later emerged that a previous customer had spilled a drink on the floor, and this had recently been cleaned up by a member of the bank’s staff. Unfortunately he had failed to dry the floor properly, and the residue of cleaning fluid and water was what caused Ms Wilson to slip and injure herself. Ms Wilson’s wrist and finger injuries were attended to at hospital, and she did not make a full recovery for over three months, during which time she was undergoing regular physiotherapy sessions.

Ms Wilson contacted Bartletts Solicitors for legal advice, and later decided to proceed with a compensation claim against the bank. We wrote to them, arguing that the floor had been in a slippery and dangerous state on the day in question, and this had directly caused Ms Wilson’s accident. The member of staff who cleaned up the spillage should have ensured that the floor was dried properly before allowing customers to walk on it, as it was otherwise reasonably foreseeable that someone would slip and injure themselves. The bank had a legal duty to provide a safe premises for their visitors, and in this instance they had failed to do so. After liability for the accident was established, Ms Wilson received £4,750 in compensation for her injuries.
