Lady Compensated For Accident Caused By Advertising Sign
Case Study - Ms Williams
Ms Williams was walking down the newspaper and magazine aisle on a supermarket, when she slipped on an advertising sign which was lying on the floor, and fell awkwardly, twisting her ankle and damaging ligaments in her knee. The advertising sign had been attached to a promotional product stand with blu-tack, but had come unstuck, and had fallen onto the floor of the aisle, directly in the path of customers. Ms Williams and her husband reported the incident to the supermarket’s management, and it was duly recorded in their accident book. They also took contact details of a lady who had witnessed the accident, and this was later to prove important in establishing the supermarket’s liability. Ms Williams suffered from pain and loss of mobility for three months following the accident, detrimentally affecting her ability to look after her two young children during that time.
Our Legal Advice
Ms Williams approached Bartletts Solicitors, and on our advice, decided to proceed with a no win no fee personal injury claim against the supermarket. We wrote to them, arguing that the advertising sign had not been properly attached to the product stand, and that blu-tack proved insufficient to hold it in place. The supermarket owed Ms Williams a duty of care, including a responsibility to take all reasonable measures to protect her from the risk of an accident on their premises. In this case, it was reasonably foreseeable that the sign would come unstuck, and fall onto the floor of the aisle where it would pose a hazard. The supermarket and its staff had therefore been negligent in failing to prevent this. After further correspondence we obtained an admission of liability from the supermarket’s insurers, and Ms Williams received £3,250 in compensation.
