Slip & Trip Accident Compensation Awards
Slips and trips often result in sprains, strains, lacerations, fractures and concussion. A minor hand injury, where a full recovery is made within a few months will lead to compensation awards between £600 and £2,750. A severe fracture to the finger, resulting in reduced mechanical function could lead to awards of up to £23,500. For a head injury which results in persistent problems such as poor concentration and mood swings in the injured person, awards will be between £9,875 and £27,500. This type of injury would be classed as minor brain damage. Most elbow injuries, including fractures and lacerations, where there is no permanent damage are worth up to £8,000. A simple fracture or soft tissue injury to the leg, where a complete recovery is made, will lead to compensation awards of up to £5,750 for a fractured tibia or fibula. The vast majority of ankle injuries are worth significantly less than £15,000, though if there is residual disability or extensive treatment required, this may rise to £32,000.
Slip & Trip Accident Compensation Case Study 1
SITUATION: Miss Bradley received
£2,500 in compensation when she slipped on a wet and slippery
floor in her staff canteen. The floor had just been mopped making it
dangerously slippery and unsafe to walk upon. Despite there being
warning signs located in the canteen Bartletts Solicitors succeeded in
proving that Mrs Jones' employers were primarily liable for the
accident arguing that there was too little friction (or grip) between
footwear and the walking surface e.g. water. Miss Bradley sustained
soft tissue injuries to her right elbow and left hip and was unable to
work for 3 weeks following her fall.
RESULT: As a result of Miss Bradley's
claim, her employers have now supplied all staff with special non-slip
shoes. Mrs Jones assisted in proving her claim by reporting the
accident to her employers straightaway and ensuring that an entry was
placed in their accident book. Mrs Jones' claim was settled within 6
months. She did not have to attend Court to give evidence against her
employers and only had to attend a short medical appointment with an
expert close to her home.
Slip & Trip Accident Compensation Case Study 2
SITUATION: Mr Jones worked in a factory
where it was common that oil would leak out on the floor. Instead of
having a proper procedure for the cleaning up of the oil, paper towels
and rags were put down which themselves became wet and slippery. Mr
Jones slipped on the oil sustaining an injury to his right knee and a
sprain to his right wrist. As he had sustained an injury at work, he
decided to bring a claim against his employer, and contacted Bartletts
Solicitors who allocated his claim to a specialist personal injury
solicitor at no cost to him.
RESULT: Mr Jones’ employers attempted to
deny liability. Bartletts refused to accept their denial and
ultimately persuaded the Defendants to settle Mr Jones’ claim. We
recovered over £8,000 on behalf of Mr Jones, and he received 100% of the compensation he was entitled to. Bartletts recovered their legal costs from his employer.
