Shoulder Injuries At Work
The flexibility and range of movement in the shoulder joint is what makes this important part of the body so susceptible to injury. The shoulder is made up of three bones, held in place by the body's normal soft tissues; muscles, tendons and ligaments. Due to the joint's inherent instability, there are multiple potential causes shoulder injury and a similarly broad range of injury types. Shoulder injuries also vary in their level of severity, and this is reflected in the recommended compensation awards.
Types Of Shoulder Injury
The most common types of work related shoulder injury are sprains, strains, dislocations, 'frozen' shoulder and repetitive use conditions. The first two types of injury commonly result from whiplash injuries sustained in car accidents. In this instance the shoulder may come into contact with a hard surface inside the car, or be wrenched by the seat belt due to the force of motion suddenly applied. Typically whiplash will cause stretching and/or tearing to the soft tissues that protect the shoulder joint. Such damage rarely results in permanent injury, though it is likely to cause ongoing discomfort over a limited period. Compensation for this type of minor shoulder injury will depend on the recovery time. If a full recovery is made in under two years, compensation will range from £2,750 to £5,000. If recovery is made within a year, compensation for the injury will be up to £2,750.
Typical Causes Of Shoulder Injuries
Shoulder injuries at work most often occur following manual handling accidents, and slips, trips and falls. The lifting of heavy objects applies pressure to the shoulder joint. Where the load is excessive, the lifting is continuous, or an awkward lifting posture is adopted, injuries to workers are the result. Damage to the shoulder's soft tissues are common, and also dislocations, where sudden, excessive pressure is applied to the shoulder joint. Heavy falls at work may also result in dislocations, where the ball of the shoulder is separated from the socket. Dislocations are classified as serious shoulder injuries, with symptoms including ongoing pain, aching in the elbow, sensory symptoms in the forearm and weakness of grip. Shoulder injury compensation awards in this category will range from £8,1000 to £12,250.
Shoulder Injury Compensation Awards
Frozen shoulder is a condition where scar tissue has formed in and around the shoulder capsule, causing limited movement. The condition normally affects the non-dominant side of the body, and though the exact causes are mysterious it is related to the over-use of one shoulder at the expense of the other. This is similar to the inflammation of the shoulder and associated soft tissues caused by repetitive use or exposure to vibrations at work, which often result in conditions such as tendonitis and bursitis. In these cases, where movement is limited and symptoms resolve themselves within two years, shoulder injury awards will vary between £5,000 and £8,100. The level of disability is the crucial factor here; a severe shoulder injury resulting in ongoing disability will lead to awards between £12,250 and £30,750. It is important to remember that these compensation awards reflect compensation for the actual injury itself, and do not include other factors for which an injured person may be compensated, including loss of earnings and the cost of medical treatment.
