What Are Basic Fees?

Standard fees charged by solicitors, normally paid by the losing party to the claim, or the latter's insurance company. Basic fees can be disputed by the losing party if they feel them to be too high. Basic fees are not paid to a client's No Win No Fee solicitors where the claim is unsuccessful.

What Are Success Fees?

An extra or 'bonus' fee charged by solicitors where a claim proves successful. The success fee should reflect the risk of losing a claim taken on by a No Win No Fee solicitor. In effect it rewards the solicitor for speculating with their services in the belief that a claim will prove successful.

What Other Costs Are Involved?

These are known as 'disbursements', and may include fees paid out for expert opinions, medical reports, accident report fees, court fees, travelling costs and barrister's fees, where a claim actually goes to court. Customers should carefully check whether these costs are covered by the terms of their No Win No Fee Agreement.

What Are 'Hidden Cost'?

Hidden costs are charges that may become due during the course of a claim in various different scenarios. If for example you choose the change solicitors during the course of a claim, the original solicitor may still be entitled to their basic and success fees. Other situations where they can arise include settling out of court against the advice of your solicitor, refusing to settle out of court against the advice of your solicitor, and deciding to drop the case altogether. A No Win No Fee Agreement should specifically address all of these possibilities.

What Is After The Event (ATE) Insurance?

This type of insurance policy is intended to cover the costs of the opposing party if the case is lost. It will also cover the cost of any fees and disbursements paid out by your solicitor. ATE insurance requires the payment of an up-front premium, which may be made by the solicitor on behalf of their client.

What Is A Claims Management Company?

A claims management company (CMC) is effectively an intermediary between client and solicitor. CMC's advertise extensively in pursuit of clients, and often undertake the preliminary research into the validity or otherwise of a claim. They then 'package up' the claim and sell it on to a firm of solicitors.

What Types Of Claims Are Covered By No Win No Fee?

No Win No Fee agreements are now available for most types of civil cases under UK law. These include accidents at work, road traffic accidents, medical negligence, accidents in public places and financial mis-selling claims.

You can rest assured that if you instruct our company you have our promise that you will not pay a penny, either out of your own pocket or out of the compensation we obtain for you, win or lose!
