What Is No Win No Fee?


The No Win No Fee (Conditional Fee Agreement) system was first introduced alongside legal aid in 1995, and completely replaced the latter in 2000. The fundamental underlying philosophy of No Win No Fee is to encourage injured parties to make compensation claims by removing the risk that, should the claim prove unsuccessful, they will face an unaffordably high legal bill. The risk is instead transferred to the firm of No Win No Fee solicitors who agree to take on the case. Essentially No Win No Fee was introduced to ensure that victims of accidents could have access to justice regardless of whether they could afford to pay legal fees.

The Benefits Of No Win No Fee Solicitors


Many articles in the press have highlighted a damaging 'compensation culture' in the UK caused by the ease with which No Win No Fee solictors allow claims to proceed. It is important to note that this is largely a myth. It is estimated that up to 2.5 million people are injured every year as a result of accidents. Where the blame for the accident or injury lies not with the victim but with a third party, it is a simple exercise of civil and legal rights to seek legal redress.

There are several further ancillary benefits to this system. Firstly the public cost of the accident in terms of services and benefits required by the injured person is met not by the taxpayer, but by the party who the courts judge responsible for causing the accident. Secondly the system encourages guilty parties to solve the problems that caused the accident, resulting in a continual reduction of similar risks posed to others. This has proved to be the reality, and the actual number of compensation claims has fallen steadily since No Win No Fee was introduced.

How Does A No Win No Fee Agreement Work?


Under a No Win No Fee agreement your solicitor will only be paid if the compensation claim is successful. The Law Society has provided a definitive model for successful claims that most solicitors firms adhere to:

If you win your claim, you pay our basic charges, our disbursements and a success fee ... You are entitled to seek recovery from your opponent of part or all of our basic charges, our disbursements, a success fee and insurance premium.

The losing party or their insurance company will therefore pay all the fees associated with the successful claim. Disbursements refers to regular costs incurred in the process to making the claim, such as court fees, payment for medical reports and expert opinions / testimony. It is important for the claimant to establish both the solicitor's basic costs and their proposed success fee at the outset. The insurance premium refers to a policy which is normally taken out before the claim begins to meet the costs of both sides should the claim fail. This premium will normally be purchased on your behalf by the No Win No Fee solicitors handling your claim. Such insurance is known as 'after the event' (ATE) insurance.
