No Win No Fee Solicitors Claiming For Work Related Lifting Injuries
Manual handling injuries particularly effect the lower back. A fractured vertebrae or disc can lead to ongoing disabilities as well as severe pain. Compensation awards in this area will be between £24,750 and £44,500. At the lower end of the scale, a strain or sprain in the back that heals fully within about 2 years will result in awards of up to £5,000. Where the healing process takes up to about 5 years, the maximum awards would be £8,000. Manual handling can also cause other injuries to the upper body, such as a dislocated shoulder, which would result in compensation awards of between £8,100 and £12,250. For a severe crush injury to the feet, resulting in permanent pain or disability, compensation awards will be between £53,500 and £70,000. A simple fracture of one or more toes, where a full recovery is made within a short period of time would lead to a maximum of £3,500 being awarded.

Manual Handling Injury Compensation Case Study 1
SITUATION: Mr Ford received
£5,000 in compensation for his personal injury claim together
with reimbursement of all of his loss of earnings whilst of he was
unable to work. Mr Ford was a delivery driver. During the course of
his employment he was required to lift large heavy blocks of cheese
into restaurants. These cheeses would weigh in excess of 25 kilograms.
Mr Ford had unfortunately not received any Manual Handling Training
from his employers and was not shown how to lift from his lorry. In
addition they did not provide Mr Ford with a colleague to assist him
with his deliveries and lifting or any mechanical assistance to lift
the heavy cheese. During the course of his employment he was lifting a
block of cheese and sustained a back injury.
RESULT: Mr Ford required considerable
time off work. He was without any income during this period and was
understandably worried about not having any income. Mr Ford was put in
touch with the Personal Injury Department of Bartletts Solicitors.
Bartletts obtained an admission of liability from Mr Ford's employers
through their Insurance company and obtained an interim payment for Mr
Ford to cover his claim for loss of earnings whilst Mr Ford whilst he
underwent a much needed course of physiotherapy. Mr Ford was examined
by an Orthopaedic expert and eventually he made a recovery from the
injuries he sustained.
Manual Handling Injury Compensation Case Study 2
SITUATION: Mr Samuel was moving loads of
bricks around his factory workplace by himself. No mechanical
assistance was provided, nor were any other employees provided to help
him move these loads. Mr Samuel was doing this job for two months, 5
days a week, and eventually his back gave way and he collapsed onto the
factor floor. His employer later admitted that they had been aware of
the weight of these loads (over 40kg), but had not risk assessed the
task so as to minimise the chance of injury to the lowest level that
was practicable.
RESULT: As a result of the accident, Mr
Samuel was unable to work for nine months and incurred travel expenses
to see consultants at various regional hospitals. Mr Samuel was paid in
full by his employer after three months, but was suffering financial
hardship due to his initial loss of earnings. Due to these
circumstances, Mr Samuel decided to bring a claim for personal injury
and contacted Bartletts Solicitors who contact his employer within a
week of Mr Samuel's instruction. Mr Samuel received £9,200
compensation within 14 months of his accident.
