Case Study - Mr Stanley
Mr Stanley worked at a storage facility operated by a home removals company, where his responsibilities included loading and unloading personal possessions into and from individual storage units. Over time, Mr Stanley began to experience periodic aching and pain in his lower back during work. His condition worsened, and on doctor’s advice, he requested to the removal company’s management that he be transferred to other less physically demanding duties. They agreed to this, but a year later Mr Stanley decided to leave the company, as he felt that there was little possibility of his career advancing with his former employer, due mainly to his back condition, which prevented him from undertaking any strenuous physical activities at work.

Mr Stanley felt strongly that his back condition had been caused by working practices at the removals company, and in particular by operations at the storage facility where he worked. His doctor had also diagnosed him as suffering from repetitive strain injury (RSI), stating that further deterioration in the strength and flexibility of Mr Stanley’s back was likely. We handled the latter’s claim against his former employer, and contacted them, arguing that our client had not received any training in safe manual handling techniques during the course of his employment. Neither had any risk assessments been carried out as to total the amount of weight that Mr Stanley was obliged to lift and carry on a daily basis. Both these factors had directly caused his back condition, and amounted to negligence on the party of the removals company. On admission of liability from their insurers, Mr Stanley later received £8,500 in compensation.
