Case Study - Mr Steven


Mr Steven was browsing the shelves in a high street shop, when he was struck on the head by a heavy boxed product that fell from the top shelf. One of the shop workers was arranging the display on that particular shelf at the time, and had dislodged the item that fell, landing on Mr Steven’s head. Mr Steven suffered a cut to the top of his head, which began to bleed, and was dazed following the accident. He received basic first aid at the scene, and later attended his local GP’s clinic, where the doctor dressed the wound, and prescribed rest and painkillers to deal with mild concussion. Mr Steven returned to the shop the same afternoon to file an accident report, and phoned Bartletts Solicitors the following day for legal advice, having read about our success in handling a case for a previous client that was similar to his.

We agreed to act for Mr Steven in a no win no fee compensation claim against the shop’s owners, and wrote to them, pointing out that the worker who was arranging the shelf admitted at the time that the accident had been his fault. By pushing one box along the shelf, he had dislodged the box that fell, striking and injuring Mr Steven. Under the Occupiers’ Liability Act 1957, the shop owed Mr Steven a duty of care, and this had been breached by the negligent actions of the shop worker. Employers are legally responsible for the actions of their employees, and in this case, given the admission of the shop worker, there was very little that the shop’s owners could dispute about Mr Steven’s claim. Mr Steven later received £2,500 in compensation from the shop’s insurers for his injuries.
