Warehouse Worker Compensated After Being Injured By Cage
Case Study - Mr Higson
Mr Higson worked at a warehouse distribution centre, where his duties included manoeuvring large metal cages, loaded with stock on different removable shelves. One day, Mr Higson was attempting the pull a loaded cage onto one of the warehouse’s scissor lifts, when it tipped towards him, and one of the shelves became dislodged, sliding off its row on the cage, and striking Mr Higson on the forehead. He sustained a deep cut, and was dazed following the accident. An ambulance was called, and Mr Higson was taken to A&E, where doctors put 10 stitches in the wound on his head, and kept him in overnight for observation due to signs of concussion. He was forced to take a week off work, and is likely to be left with a permanent and visible scar on his forehead as a result of the accident.
Our Legal Advice
Mr Higson was angry and upset by the fact that his employer (a major supermarket chain) refused to accept responsibility for the incident. He contacted Bartletts Solicitors for advice, and later engaged us to handle his personal injury claim against the supermarket. A colleague of Mr Higson’s made a statement confirming our client’s story; that the shelf that had fallen off the cage had not been secured properly by one of their co-workers when it was loaded. It was therefore reasonably foreseeable that when the cage tipped, the shelf would fall onto whoever was pulling it at the time. Employers are responsible for the behaviour of their workers under the principle of vicarious liability, and were therefore ultimately to blame for the error that caused Mr Higson’s injury. After a few months of correspondence, we obtained an admission of liability, and our client later received a total of £5,500 in compensation.
