Compensation For Worker Injured At Tesco Distribution Centre
Case Study - Mr Thompson
Mr Thompson was working at a Tesco distribution centre, when he injured his back due to heavy lifting. Mr Thompson’s duties involved unloading pallets of products from lorries, which were then transferred to the warehouse’s storage sections. One afternoon, the pallet truck that Mr Thompson and his colleague normally used for unloading was undergoing maintenance, and to save time, they decided to transfer the pallets manually to the storage bay. While lifting one heavy pallet, Mr Thompson felt a sharp pain in his lower back, and had to stop work immediately. He was in severe pain and could not walk unassisted. He was taken to hospital where doctors discovered that he had slipped a disc in his lumbar (lower back).
Our Legal Advice
Mr Thompson was off work for 6 weeks following his injury, and upon returning to work found that he could not carry out his duties to his former capacity. We represented Mr Thompson on a no win no fee basis in a compensation claim against Tesco. We argued that under general legislation regarding the responsibilities of employers, Tesco should not have allowed the distribution centre to be lacking such essential lifting equipment on the day in question. Mr Thompson’s injury was a direct result of his employer’s failure to provide to necessary mechanised assistance for unloading the pallets. After a few months of correspondence, we won an admission of liability from Tesco, and Mr Thompson later received £7,500 in compensation.
