Hearing Loss Compensation Case Study 1
SITUATION: Mr Green worked in a
printers between 1969 and 1982. The area where he worked was in amongst
the printing machines which were all in one room. This was extremely
noisy and Mr Green was unable to speak to his colleagues who were only
quite close without shouting. Mr Green was never given any hearing
tests nor was he provided with any hearing protection. It was not until
2007 that Mr Green noticed significant problems with his hearing.
RESULT: As Mr Green's former employers were no longer in existence his first question was to us was; can I claim compensation for hearing loss from my previous employer which no longer exists? Our solicitor informed him that it is possible to obtain compensation for hearing loss when the company he worked for no longer existed. We contacted the ABI (The Association of British Insurers) who, after several months of searching, provided us with details of the insurers for the relevant period when Mr Green was employed. We successfully recovered £4,000 on Mr Green's behalf.
Hearing Loss Compensation Case Study 2
SITUATION: Mr Meredith worked as a
spinner and doffer in a cotton mill in Oldham in Manchester. The Mill
had been demolished for over 20 years. He was offered the opportunity
to attend for a free hearing test. He was convinced that he had no
problems with his hearing, but his wife frequently complained that he
had the tv too loud, shouted on the phone and had selective hearing
when she was trying to speak to him. He was surprised when he was told
that his hearing loss was due to his employment.
RESULT: Mr Meredith's first question to our lawyer was; am I entitled to compensation for hearing loss when I stopped working a long time ago? Once we had investigated the facts of his case we informed him that he was entitled to compensation. Furthermore, that we could offer him a no win no fee hearing loss solicitor's agreement so that he would not pay a penny win or loss and keep 100% of his damages. Our company went onto successfully locate his former employer's insurer despite the fact that the company had dissolved. Mr Meredith was very happy that we were able to obtain for him £4,500 compensation for his hearing loss.
