Farm Accidents Compensation Awards
Farm accidents result in injuries of varying levels of severity. Compensation awards will depend on the nature of the injury and the resulting ongoing side effects. Compensation awards for fractures to limbs such as elbows, wrists and hands will depend on whether the fracture is complicated or uncomplicated. Where a full recovery is made awards for these types of fractures will rarely exceed £8,000. Accidents involving machinery can cause crush injuries leading to amputations in the most serious cases. The loss of one hand would lead to awards ranging from £61,500 to £70,000, and for both hands, the highest award would be £129,000. Awards for the loss of a leg or arm are higher. Falls from height often result in head injuries, where compensation will range from £1,400 to £8,100 for a minor injury, to well over £200,000 where severe brain damage has been sustained. An extensive fracture of the pelvis or hip can lead to ongoing difficulties and compensation awards will vary between £50,000 and £83,500. The vast majority of ankle injuries result in compensation of up to £15,000. Where a disease such as asthma has been caused by working conditions, and future employment prospects are restricted, compensation awards will range from £27,500 to £42,000.
Farm Accident Compensation Case Study 1
SITUATION: Mr Williams was asked
by his employer to replace guttering on a farm outhouse. He climbed a
ladder and used a plank of wood to enable him to stand on the roof
while performing the task. As it began to rain Mr Williams slipped on
the plank of wood, and fell backwards through the roof of the building
onto the concrete floor below. He sustained a fractured back, and
severe concussion.
RESULT: Mr Williams was off work for over
3 months. He subsequently made a full recovery. Mr Williams used
Bartletts to bring a compensation claim against his employer. We
pointed out that no training has been provided in working at height.
Further no safety equipment to prevent a fall was present. The roof was
also in a particularly poor state of repair. Mr Williams's claim was
settled within 9 months of him instructing us. He was awarded
compensation of £18,500, reflecting pain and suffering and
the future risk of further back problems developing.
Farm Accident Compensation Case Study 2
SITUATION: Mr Pavel worked as a
fruit harvester in East Anglia. His job required him to work on a
trailer behind a tractor transferring blackcurrants from a harvest
shoot to wooden palettes and stacking them on the trailer. The tractor
stopped in the middle of a field, but accelerated again just as Mr
Pavel was stacking a full palette at the back of the trailer. The
sudden motion caused Mr Pavel to fall from the trailer, and the box of
fruit fell with him, causing a heavy impact to his foot. Mr Pavel was
found to have suffered a broken ankle and severe bruising to his leg.
RESULT: Mr Pavel's employers denied
liability, claiming that the injured party had acted irresponsibly and
should have been aware that the tractor would move off again while he
was stacking. We refused to accept this, arguing that the driver should
have used his rear view mirror to check that it was safe to proceed. We
ultimately recovered over £5,000 compensation for Mr Pavel.
Bartletts fees were paid by the employer, and he kept 100% of the
compensation.
