Falls At Work Compensation Awards
Falls at work result in a wide variety of injuries, but most commonly include head injuries, back and spinal injuries, and injuries hands, wrists, legs, ankles and feet. Compensation awards for fractures depend in large part on the level of disability caused, and the ongoing side effects of the injury. A multiple fracture to the leg for example may take years to heal and arthritis may develop in the joint. A compensation award for this type of injury may be up to £54,000. A deep laceration to the hand, resulting in permanent disability would lead to an award of up to £8,000. A severe back injury may have long term consequences such as impotence or incontinence. Awards in this area would be up to £108,000. Compensation for a minor head injury ranges from £1,400 to £8,100. Where brain damage has occurred however, awards can rise £257,750 where the injured person shows little response to surroundings and requires full time care.
Fall At Work Injury Compensation Case Study 1
SITUATION: Mr Roberts was at
work, and climbed on a table to adjust the position of a television.
The television fell from the wall while he was doing it, and Mr Roberts
fell off the table. He sustained an injury to his lower back, and was
absent from work for 7 weeks.
RESULT: Mr Roberts' employers denied
liability for the accident and argued that he should not have touched
the television. We argued that it
was not safe and could have fallen at any time if it so easily came
away from the wall whilst being adjusted. Liability was eventually
admitted and Mr. Roberts received £4,500 in compensation.
Fall At Work Compensation Case Study 2
SITUATION: Mr Gerald received
£4,500 compensation when he fell from a ladder while at work.
He was employed as a fork lift truck engineer. He had to fix the mast
on the top of a fork lift truck. His employer had not provided him with
a ladder, so he used the ladder at the premises. He climbed to the top
of the ladder and it slipped, causing him to fall on to the forklift
truck and sustain a serious sprain to his ankle.
RESULT: Mr Gerald was off work for 2
months. His employer did not pay him so he decided to bring a claim and
contacted Bartletts solicitors who allocated his claim to a specialist
personal injury solicitor at no cost to him. Within 5 months of
starting his claim, we had obtained an interim payment for Mr Gerald
for his loss of earnings. He was examined by a medical expert, and his
claim was settled within 9 months of him instructing us.
