Falling Object Injury Compensation Awards
Falling object injuries normally affect the head or brain, face, neck, back and spinal cord. Compensation awards will therefore be specific to each injury type. For a minor head injury compensation awards will be between £1,400 to £8,100. Where serious brain damage has occurred, awards can be as much as £257,750. Awards for facial scarring a particularly weighted towards the age and sex of the injured person. A male under the age of 30 may be awarded up to £42,000 for severe facial scarring, and for a female the upper bracket rises to £62,000. Where scarring affects other parts of the body, awards normally range between £4,750 to £9,000 for a number of noticeable, or a single disfiguring scar. A common injury from falling objects is damage to the brachial plexus (an arrangement of nerves near the top of the spine). An injury in this area can also damage the spinal cord, and compensation awards will range between £42,000 and £83,500.
Falling Object Injury Compensation Case Study 1
SITUATION: Mr Roberts was
employed as a Gas pipe layer. He was at work when a gas pipe fell out
of a JCB because it was not adequately secured. Mr Roberts sustained a
fracture to his right foot.
RESULT: We were able to pursue a
successful claim for him because his employer had failed to provide a
safe place and system of work, and breached the Construction Site
Regulations. His work related injury was due to his employers failure
to properly implement an adequate health and safety policy. His case
settled for £4,000 and we recovered the cost of private
medical treatment for him under a private policy.
Falling Object Injury Compensation Case Study 2
SITUATION: Mr Long was working in a
warehouse as a supervisor. He was struck in the face by a spanner that
was being used at the top of the warehouse by a contractor. Mr Long was
off work for one month as a result of the accident.
RESULT: Mr Long contacted Bartletts
Solicitors who allocated his claim to a specialist personal injury
solicitor on a No Win No Fee basis. Mr Long's employer admitted
liability for the accident after Bartletts Solicitors had notified them
of Mr Long's claim. Mr Long was examined by a GP who prepared a report
on his injuries. Mr Long received £3,500.00 compensation,
keeping 100% of the compensation due to him.
