Facial Injuries At Work

The face is the most exposed part of the body and therefore at almost constant threat of injury from unforeseen dangers. The jaw and nose are the two parts of the face most susceptible to facial fractures, while lack protection for the eyes render them vulnerable to potentially life-altering damage. Facial injuries involve a high level of trauma, and the ancillary effects of this trauma can be severe, including a level of deformity, a period unconsciousness and associated damage to the brain. Compensation awards for facial injuries are based on these physical implications of the injury, but also take into account the ongoing psychological damage caused by the injury. The cosmetic effect of the injury and the cosmetic surgery requirements of the injured person are also particularly taken into account.

Types Of Facial Injury

Apart from fractures to facial bones, including the cheek bones, and trauma to the eyes, the most common types of facial injury include bruising or swelling of the mouth, bleeding from the nose, mouth or ears, lacerations, abrasions and burn injuries. All these types of injury may result in temporary or permanent facial scarring and disfigurement. Facial injuries also include loss of teeth, where the cosmetic effect of the injury will be important, along with the need for current and future corrective orthodontic work. Severe injuries to the eyes or ears can ultimately result in partial or total loss of either sight or hearing. Facial damage may even affect a person's ability to breath in extreme cases. Particularly serious facial trauma can ultimately result in damage to the injured person's brain. Such injuries can have life-altering consequences for all parties concerned.

Typical Causes Of Facial Injuries

Facial injuries at work most often occur following fights between co-workers. Depending on the precise behaviour of the person held most responsible for the fight, an employer may be vicariously liable for the actions of their employee, given their duty to ensure a safe working environment. Objects falling from height and airborne flying objects present a threat of facial injury in the workplace, and workers may also be struck by unsecured parts from machines or tools. Employees may damage their face or teeth in a slip or trip accident, or come into contact with hazardous chemicals, hot liquid or naked flame. Factory, warehouse, construction, kitchen and laboratory workers are all regularly exposed to such risks in their working environment, along with engineers and those who work at height. An employer has a duty to ensure that workers are provided with the appropriate personal protective equipment to wear in the course of their job. Most importantly the employer has a duty to provide a safe system of work for all employees. Failure in either of these areas may be grounds for an injured person to bring a compensation claim against their employer.

Facial Injury Compensation Awards

Compensation awards for facial injury vary according to the age and sex of the injured person, and the level of cosmetic damage visible from a conversational distance. A multitude of other factors may also be taken into account including the psychological effects of both the injury itself and its consequences. Burn injuries may merit higher compensation awards depending on the nature of any deformity, ongoing pain and cosmetic surgery needs. Where damage to the brain has been caused the value of compensation awarded may rise exponentially. Females generally receive higher awards where facial damage has caused some level of deformity, as they are judged to be more conscious of their physical appearance. Where severe facial scarring has been sustained by a young woman, compensation awards will be between £31,000 and £62,000. Where the scarring is relatively minor awards will vary between £2,500 and £8,750. Males under the age of 30 with severe facial scarring will be awarded between £19,000 and £42,000 in compensation. Where the scarring is only visible on close inspection compensation for males will range between £2,500 and £5,850. A simple fracture of the nose will result in compensation awards between £1,100 and £1,600. This upper limit may rise to £14,750 for serious or multiple fractures with accompanying deformity. Compensation of loss of teeth will range form £700 for the loss of damage of one back tooth to a maximum of £7,250 for the loss of or serious damage to several front teeth.
