Claim Compensation For Injury From Malfunctioning Work Equipment
Defective work equipment can cause a wide range of injury types of varying levels of severity. Compensation awards will depend on the nature of the injury and also the longer time side effects caused. A laceration may result in a finger amputation for example, potentially causing permanent lack of grip. Awards in this area begin at £5,500 and may exceed £14,000. The loss of an arm will result in a compensation award of not less than £87,500. A minor fracture of the wrist, potentially caused by a fall from defective scaffolding, where a full recovery is made relatively quickly would lead to an award of between £2,250 and £3,000. Scarring is a common injury type caused by burns or lacerations from defective equipment. A facial scar suffered by a male, that is visible at conversational distance will result in compensation awards of between £5,850 and £11,500. Where such scarring is permanently disfiguring, the upper bracket may rise to £42,000.
Defective Equipment Injury Compensation Case Study 1
SITUATION: Mrs Smith worked as a
teacher in a school when, was acting in the course of her employment,
she lowered herself to sit upon the seat of an armchair in the
classroom. The seat failed to support her and she fell through it to
the floor sustaining a work related injury. Mrs Smith was not severely
injured although she was in a lot of discomfort for almost a year.
RESULT: Mrs Smith's employers admitted
liability for the accident. Mrs Smith sustained a soft tissue injury to
her back and was unable to work for 9 weeks following the accident. Mrs
Smith was able to claim back her lost earnings as well as travel
expenses in attending doctor's appointments. Mrs Smith's claim settled
within 12 months and she did not have to attend Court. Mrs Smith
received 100% of her compensation in the sum of £5,800.
Defective Equipment Injury Compensation Case Study 2
SITUATION: Mrs Trainer received
£4500,00 compensation when she sustained personal injuries as
a result of using defective equipment at work. She was employed as a
night shift worker at an ice cream factory. She normally worked as a
machine worker but on the day of her accident she was not carrying out
her normal role. She was pushing a 'glue' bin and as one of it's wheels
was not working properly the bin jammed. As a result she sustained a
jarring injury to left shoulder and neck.
RESULT: Mrs Trainer was off work for 7
weeks resulting in a loss of earnings. Bartletts Solicitors arranged
for her to be medically examined by an expert local to her. The medical
expert thought that she would make a fully recovery from her injuries.
She recovered compensation for her injuries and loss of earnings.
