Customer Injured After Leaked Bleach Got In Her Eyes
Case Study - Mrs Jackson
Mrs Jackson was out shopping with her daughter at a supermarket, and had loaded her purchases onto the checkout belt, when it became apparent that the customer in front had spilled a bottle of bleach in her basket, and some liquid had leaked out onto the checkout belt. The assistant working on the checkout was informed, and attempted to wipe up the bleach with a paper towel. The customer responsible for the leak left the store, and Mrs Jackson put her food through the checkout. She did not see any bleach, but stated later that she could still smell it, and she remembered that her eyes were watering as she paid for her goods. When she picked up her bags however, she noticed that they were wet form the bleach on the bottom, and she therefore asked for more paper towels to wipe them with. On her way home Mrs Jackson’s eyes were burning, and she realised that she must have inadvertently rubbed bleach into her eyes.
Our Legal Advice
Mrs Jackson’s eyes were swollen, bloodshot and painful for days afterwards. She was upset and angry about the whole situation, because she felt that the incident had in no way been her fault. After visiting one of our local offices, Mrs Jackson decided to proceed with a no win no fee compensation claim against the store’s owners. We argued that insufficient attempts were made to wipe up the bleach when the spillage was first noticed and pointed out to staff. The checkout area was clearly not free from bleach when Mrs Jackson was putting her food through it, and this allowed her to rub bleach from the bottom of her shopping bags into her eyes. Staff at the store were negligent in failing to deal properly with the spilled bleach, thereby exposing our client to the risk of physical contact with it. The store’s insurers accepted liability for Mrs Jackson’s eye injury, and our client received compensation totalling £3,250.
