Case Study - Tenant Bitten By Bed Bugs Repeatedly At Rented Property
Mr D launched a compensation claim against his private landlord after he was bitten by bed bugs over a period of 4 months. Despite having been made aware numerous times about the bed bug infestation at his property, the landlord had failed to contact a pest control service to eradicate the problem. At first, Mr J thought the marks and swelling on his legs and ankles were symptoms of an allergic reaction, but his doctor rightly recognised that they were caused by bed bug bites. Mr J complained to his landlord’s agent, who promised to arrange a specialist service to deal with the infestation. However, he failed to do so, and in the meantime Mr J experienced sleeping difficulties, as well as constant itching and irritation due to the number of bites covering his body. After 16 weeks of waiting for a solution, Mr J decided to seek legal advice.

Mr D later engaged Bartletts Solicitors to handle a compensation claim against his landlord, for the physical injuries and emotional distress that the bed bug infestation had caused him. In representing Mr D, we argued that the property was effectively in a state of disrepair during the time that it was infested with bed bugs. Our client had informed the landlord’s agent by phone, e-mail and letter about the problem, yet no action had been taken to disinfest the property. As per the Housing Disrepair Protocol 2003, landlords are obliged to address the concerns of their tenants within 20 working days, but in this case Mr D had waited 4 months without hearing anything. An environmental health officer had visited the property and confirmed the infestation, and this along with Mr D’s medical reports were enough to win a judgment against the landlord, with Mr J receiving £3,250 in compensation for the ordeal he had been put through.
