Case Study - Mr Deacon
Mr Deacon was employed part-time by a national supermarket chain, where his duties included stacking and arranging products on shelves at the store where he worked after it had closed for the day. One evening he was standing on the steel kick step stool that he routinely used to reach the higher shelves, when the stool slipped from under him, causing him to fall off it. Mr Deacon landed awkwardly, and dislocated his shoulder in the process. His manager called an ambulance and Mr Deacon was taken to hospital, where doctors successfully relocated his shoulder, and immobilised the joint in a sling. He was unable to return to work for 2 months following the accident, and left the company shortly after his return to work, due to dissatisfaction with the number and timing of shifts that he was being allocated.

Mr Deacon decided to seek legal advice almost immediately following the accident, and Bartletts Solicitors subsequently represented him in a personal injury claim against the supermarket. We argued that the step stool that Mr Deacon was using on the evening in question was defective, as part of the non-slip rubber base ring was missing, meaning the stool was unbalanced, and likely to slide on its exposed metal edge when a person’s weight was placed on it. The details of Mr Deacon’s injury had been recorded in the store’s accident book, and statements from both Mr Deacon’s shift manager and a colleague confirmed the defective state of the steel kick step tool at the time of the accident. We were able to obtain an admission of liability from the supermarket’s insurance company, and Mr Deacon later received £5,500 in personal injury compensation.
