Ankle Injury After Trip Over Raised Paving Stone In Car Park
Case Study - Mr Warner
Mr Warner was leaving his local supermarket, when he tripped and fell over a raised paving stone in the car park. His girlfriend called supermarket staff for assistance, and Mr Warner was taken to hospital. After an X-ray, Mr Warner was diagnosed with a dislocated ankle. A plaster cast was applied, and Mr Warner was discharged from hospital on crutches two days later. His girlfriend meanwhile had returned to the supermarket the day of the incident to file an accident report. She also took photos of the raised concrete paving stone, which was clear evidence that the surface in question was treacherous.
Our Legal Advice
Mr Warner decided to engage Bartletts Solicitors to handle a claim for compensation against the supermarket. We wrote to them enclosing the photographs of the raised paving stone, and referencing the accident report that Mr Warner’s girlfriend had filed with the supermarket’s manager. We stated that the supermarket had failed to provide a safe premises for their visitors. In reasonable circumstances it could have been expected that someone would fall over the raised paving stone and injure themselves. This was therefore a maintenance failure. The supermarket accepted liability and Mr Warner received £3,000 in compensation.
