Case Study - Mr Douglas
Mr Douglas slipped over some cardboard that had been placed in the entrance of his local supermarket during freezing conditions last winter. Supermarket staff had placed the cardboard in the entrance to deal with snow that was being trampled into the store by customers. The cardboard had dissolved over time, and this was what caused My Douglas to slip, lose his balance and fall. He suffered a badly sprained ankle and strained wrist. Mr Douglas’s wife reported the accident to the supermarket’s management, and then drove Mr Douglas to hospital where he received emergency attention.

We began a claim against the supermarket, on the basis that, while it was reasonable to use cardboard to combat the winter conditions, it was unreasonable that the cardboard had been left to deteriorate to the extent that is posed a slipping hazard to visitors.
