Compensation For Lady Who Slipped On Rice In Shop
Case Study - Mrs Dobson
Mrs Dobson was shopping in a local convenience store one evening when she unexpectedly slipped in one of the aisles, tearing ligaments in her wrist and dislocating her finger in an attempt to break the fall. Mrs Dobson had failed to spot grains of rice, which were scattered on the floor in that area of the shop, after a bag had been knocked off the shelf by a previous customer and had split. The convenience store’s manager later admitted that they had been aware of the spilled rice for at least 20 minutes prior to the accident, yet no action had been taken to clear up what was an obvious hazard to anyone walking down that particular aisle. Mrs Dobson was a severe pain following the incident, and was driven to A&E by her daughter. She was later discharged with her wrist and finger in a splint, and experienced significant difficulties carrying out basic functions for the next 6 weeks.
Our Legal Advice
Mrs Dobson decided to seek legal advice, and got in touch with
Bartletts Solicitors, after reading about a successful personal injury
claim we handled previously, that involved circumstances similar to
her own. We agreed to represent her and wrote to the convenience
store’s owners and insurers, arguing that spilled rice on the floor of
an aisle represented an obvious danger, and one that would foreseeably
cause an accident. The store’s management and staff had behaved
negligently in failing to clear up the rice within a reasonable time
frame, thereby directly causing Mrs Dobson’s injuries. We were able to
win an admission of liability from the convenience store’s insurers,
and our client later received £3,500 in personal injury
compensation.
