Compensation For Sprained Ankle After Slipping On Ice At Work

Case Study - Mr Andrew

Mr Andrew was using the outdoor walkway that led from his office car park to the main office building early one morning, when he slipped and fell on a patch of ice, badly spraining his ankle. The car park and walkway were normally gritted each morning during freezing conditions before employees arrived for the day. In this case however, the maintenance workers responsible for gritting were running late, and had only just begun to grit the car park by the time Mr Andrew arrived. Mr Andrew’s ankle began to swell up immediately following the accident, and he was taken to hospital, where doctors diagnosed an inversion sprain and partially torn ligaments. Mr Andrew was forced to take 2 weeks off work due to his sprained ankle, and was on crutches for 6 weeks.

Our Legal Advice

Mr Andrew was upset that his employer refused to accept responsibility for the accident, and decided to make a claim for compensation using the no win no fee services of Bartletts Solicitors. We contacted his employer, arguing that the car park and walkway outside Mr Andrew’s office should not have been accessible on the day in question, before the maintenance staff had finished treating the surfaces with grit. Freezing conditions overnight had left the walkway in a slippery and dangerous state that morning, making it reasonably foreseeable that Mr Andrew would slip and injure himself while attempting to get from the car park to his office building. On admission of liability, Mr Andrew received £2,400 in personal injury compensation from his employer’s insurers.
