Case Study - Ms Wesley
Ms Wesley was working in a restaurant, when she was scalded by boiling water that was spilled over her by a colleague with whom she collided in the kitchen. She sustained second degree burns to her chest and arms, and was in severe pain and hysterical following the accident. The restaurant had not provided Ms Wesley with a protective apron, which most of the other kitchen workers wore, and this would have protected her from the worst effects of the boiling water. Ms Wesley’s skin was red and swollen, and soon began to crack and blister. Her injuries caused her pain and discomfort for 4 weeks after the incident, though she was not left with any permanent scarring. She was however off work for 3 weeks, and being a part-time worker was not paid during that time.

Ms Wesley got in touch with Bartletts Solicitors having read about our experience representing a kitchen worker who was burnt in similar circumstances. We acted for Ms Wesley in a compensation claim against the restaurant’s owners, and wrote to them, arguing that her injuries were caused by the negligence of her co-worker, who had been to blame for colliding with our client. Statements from other colleagues confirmed this version of events. We also pointed out that it was unacceptable that Ms Wesley had not been provided with protective overalls, as in such a busy environment as the kitchen, it was reasonably foreseeable that hot food and liquids could be spilled, causing injury.
