Trainee Chef Compensated For First Degree Burns
Case Study - Mr Bradley
Mr Bradley was working at a hotel in the Lake District as a trainee chef. One lunchtime, during a particularly hectic period, Mr Bradley collided with a waitress in the hotel’s kitchen, who was carrying a cafetiere of hot coffee that spilled all over him. He suffered first degree burns to his forearms and hands, and received basic first aid at the scene of the accident. He was later taken to hospital by ambulance, where his wound was properly treated and bandaging was applied. Mr Bradley was off work for 3 weeks, and suffered ongoing pain and sleeping difficulties for months afterwards. He was also upset and angry, as it was clear to him that the accident had in no way been his fault.

Mr Bradley decided to seek legal advice, and subsequently instructed Bartletts Solicitors to represent him in a compensation claim against his employer. Evidence from co-workers backed up Mr Bradley’s story, that he had been in his usual position in the kitchen at the time of the accident, and had turned round just at the moment the waitress ran into him. She had been chatting with one of the chefs, and was not paying attention when she collided with Mr Bradley. Under the principle of vicarious liability an employer is legally responsible for injuries caused by co-workers, and in this instance, the negligence of the waitress had been the principle cause of Mr Bradley’s burns.
