Construction Worker Caught Dermatitis From Mixing Cement
Case Study - Mr Graham
Mr Graham was working on a major construction project, where his duties involved mixing and transporting wet cement to make concrete. After a few months he developed chronic irritant contact dermatitis on his hands and forearms, an inflammatory skin disease caused by over-exposure to the caustic elements in wet cement. Mr Graham’s skin was swollen, red and itchy. Cracks in the skin later formed blisters, and the condition continued to cause Mr Graham considerable discomfort and sleeping difficulties. Mr Graham was forced to take a month off work while his condition was treated by doctors. As he was employed part-time by a contractor on the building site, Mr Graham received no sick pay during that period.

Mr Graham contacted Bartletts Solicitors, as he was upset with the treatment he had received from his employer, and felt that unsafe working conditions has caused him to contract dermatitis. Though Mr Graham had been provided with boots and gloves on the site, this protective equipment was inadequate given the level of exposure to wet cement faced by Mr Graham on a daily basis. Furthermore, washing facilities on the building site were located almost half a kilometre away from where Mr Graham was working, and he therefore did not have ready access to them. His employer had therefore negligently failed to take the necessary measures to protect Mr Graham from the risk of contracting irritant contact dermatitis on the site. Following admission of liability, Mr Graham received £2,250 in compensation, as well as a further sum to cover his loss of earnings due to time off work.
