Pizza Delivery Man Compensated For Dog Attack
Case Study - Mr Barry
Mr Barry was working part-time as pizza and fast food delivery person for a local restuarant. One evening he was delivering food to a customer, and was waiting outside the front door after ringing the door bell. When the door opened, two dogs ran out, and one, a Staffordshire Bull Terrier jumped on Mr Barry, knocking him over, before biting his arm and hand, as well as scratching his face. The owner of the property managed to bring the dog under control, and called an ambulance for Mr Barry. He was taken to hospital, where he was given a tetanus boost, his bite wounds were stitched up, and he was prescribed a course of antibiotics to guard against the risk of infection. Mr Barry is likely to be left with some level of permanent scarring from his wounds, and may require skin graft surgery in the future to regain a normal appearance.

Mr Barry contacted Bartletts Solicitors on the advice of his employer, and we went on to represent him in a personal injury claim against the dog’s owner. In this instance, the owner had third party insurance for his dogs, and we wrote to his insurers, stating that our client had sustained serious injuries from the bites and scratches of the Staffordshire Bull Terrier. It was established that the dog had a history of aggressive behaviour, and had also bitten the local postman on the hand previously. The owner’s pet insurance policy covered injuries to members of the public and visitors to the residence, and in this case, it was relatively easy to establish liability, based on the medical evidence and the dog’s history. Within a few months of starting his claim, Mr Barry received £5,500 in compensation for his injuries.
