Decorator Injured After Ladder Slips From Under Him
Case Study - Mr Briggs
Mr Briggs was working as a part-time painter / decorator, employed by a building firm on some new-build residential properties. He and his colleagues were rushing to meet a deadline for completion, and were working over-time one evening when an accident occurred. Mr Briggs was using a ladder to paint the top section of the walls, and was precariously balanced, when the ladder slipped away from under him, causing him to fall face-first onto the ground. He cut his cheek and sprained his wrist in the fall, and was unable to carry out any further work on the project.

Mr Briggs contacted Bartletts Solicitors with a view to making a claim against his employer. It emerged that Mr Briggs had only been on the job for two days, and had been given a ladder with no rubber strips on the bottom to support it. This had caused the ladder to slip away from under him. Neither had Mr Briggs received any training or induction in the safe use of ladders and working at height. The accident was therefore caused by the failure of his employer to provide Mr Briggs with a safe ladder, and their failure to provide him with adequate safety training. The employer accepted liability for the accident, and Mr Briggs was awarded £2650 in compensation for his injuries.
