Case Study - Mr Simpson
Mr Simpson was working in the kitchen of a hotel preparing breakfast one morning, when his hand became trapped in the toaster grill, which was switched on. Mr Simpson suffered second degree burns on both sides of his hands, and was in severe pain and distress. An ambulance was called, and Mr Simpson was taken to hospital, where doctors dressed and bandaged his wounds before discharging him. Mr Simpson experienced continual pain and discomfort in his hand following the accident, and was unable to return to work for 3 weeks. Months later his skin is still scarred by the burns, and he is considering corrective skin graft surgery. He was particularly upset by the failure of the hotel’s management to apologise or offer him any redress, and decided to seek legal advice.
Our Legal Advice
Mr Simpson engaged Bartletts Solicitors to represent him, and we wrote to his employers, pointing out that our client had not received proper training in how to use kitchen appliances at the hotel. On the day of the accident the kitchen was also short of staff, and this had created a pressurised situation, in which it was reasonably foreseeable that an accident would occur. The hotel had therefore failed in the duty of care it owed to employees, such as Mr Simpson, to provide them with a safe premises and safe system of work. Initially the hotel’s owners denied liability, claiming that the injury had been Mr Simpson’s fault. Following further negotiations however they accepted partial liability for the incident, and Mr Simpson received £7,000 in compensation for his injuries and the cost of medical treatment he had incurred.
