Case Study - Mr Ahmed


Mr Ahmed worked as a web designer for a respected homeware company, where he was involved in time sensitive technical projects that required long hours at his workstation in front of a computer screen. After working for weeks on one particular project, Mr Ahmed developed constant pain in his back, shoulders and neck, that forced him to take time off work and visit his GP, who diagnosed an upper limb disorder caused by repetitive strain injury. Mr Ahmed was ultimately unable to return to work on the web design project, and lost considerable earnings as a result. Many months later he was still experiencing aches and pains in his upper body, and was restricted in the amount of time he could spend using computers.

Mr Ahmed contacted Bartletts Solicitors having read an article on our website concerning the effects of workstation ergonomics on the upper body, and the responsibilities of employers in this area. We agreed to represent him on a no win no fee basis, and wrote to his employer, pointing out that Mr Ahmed was expected to work very long hours at his workstation in the office, often late into the night. Despite this however, Mr Ahmed’s chair was not height-adjustable. This meant that he was seated too low, constantly having to look up at the screen, placing continual strain on his back, neck and shoulders. His employer had therefore failed to risk assess ergonomic factors in the workplace, and this had caused Mr Ahmed to develop chronic pain in his upper body. After liability was accepted by the employer’s insurers, Mr Ahmed received £3,500 in compensation.
