Case Study - Mr Thompson
Mr Thompson was shopping in a furniture superstore, when he was injured by a heavy boxed item that fell from one of the top shelves, striking him on the cheek and the side of his head. He had been reaching for another product when the accident occurred. The boxes were stacked three high on the shelf, and had been left in a fragile position by a former customer, meaning it was likely one or more would fall if they were even slightly further unbalanced. Mr Thompson sustained a deep cut to cheek, as well as bruising around his eye. He required stitches in his wound at hospital, and was told to rest for a few days due to the risk of possible concussion. Mr Thompson had reported the accident to the superstore’s manager at the time of the incident, and the details had been recorded in their accident book.

Mr Thompson decided to seek legal advice, after he received no further contact from the superstore concerning the incident, and Bartletts Solicitors subsequently agreed to represent him in a no win no fee claim against the store’s owners. We contacted them, pointing out that they should have had enough staff on hand to deal with foreseeable risks, such as heavy products poorly stacked on one of the top shelves. Under the Occupiers’ Liability Act 1957, the owners and occupiers of public premises, including shops and superstores, owe a duty of care to their customers, and must take all reasonable measures to protect them from the risk of injury while on their premises. In this case, staff had negligently failed to take these necessary measures, directly causing our client’s injuries. We were able to obtain an admission of liability from the store’s insurers, with Mr Thompson later receiving £3,250 in compensation.
