Employers face various responsibilities towards their workers (and other lawful visitors) during freezing conditions. They must ensure they have enough grit stored to deal effectively with ice and snow in outdoor areas at their premises, including traffic routes, access paths and car parks. In subzero temperatures, grit should be laid before workers or other visitors, such as members of the public and delivery drivers, begin to arrive for the day. Gritting may need to be carried out at regular intervals throughout the day, subject to risk assessments, and employers are expected to be aware of prevailing conditions and the weather forecast. In terms of claiming compensation, the test will be whether the inaction of an employer directly caused an accident, that was reasonably foreseeable given the weather conditions at the time.

Under the Occupiers Liability Act 1957, owners and occupiers of commercial premises owe their lawful visitors a duty of care, and must take all reasonable measures to reduce the risk of injuries on their premises to the lowest possible level. They should have sufficient supplies of grit in stock to deal with a severe frost, and must make sure gritting is carried out as the conditions demand. Ice can cause customers to slip and injure themselves in the car park or near the entrances and exits to shops and supermarkets. There is also the risk of vehicle accidents occurring as visitors arrive or leave. As in all ice and snow injury cases, it will need to be shown that an accident was reasonably foreseeable given prevailing weather conditions, and that the negligence of management or staff (normally in failing to grit public areas adequately), directly caused a person's injuries.
