Case Study - Mrs Johnson's Son


Mrs Johnson took her 9 year old son to a children’s swimming period at her local leisure centre. She left her son at the pool under the supervision of a lifeguard and swimming instructor, while she went for a coffee with a friend. Half an hour later she was alerted by a member of staff that an accident had occurred, and that her son had slipped and knocked himself out beside the pool. He had regained consciousness shortly afterwards, but was immediately taken to hospital, where an X-ray found no serious damage. He was kept in overnight for examination, and returned home the next day.

It later emerged that the swimming instructor had been called to the telephone during the class, and the children had been allowed by ‘free swim’ session while he was away. The young lifeguard had failed to prevent the children indulging in dangerous behaviour, including running and ‘bombing’ into the pool. This was how Mrs Johnson’s son slipped and banged his head. Under the Occupiers Liability Act 1957, the leisure centre had a responsibility to provide visitors with a safe environment. In this case the children had not been properly supervised, and due to this lack of supervision, it was reasonably foreseeable that they would indulge in dangerous behaviour, potentially causing injury. Mrs Johnson’s son was awarded £3,250 in compensation, to be held in trust for him by the court until he reaches the age of 18.
