Case Study - The Allen Family


Ms Allen was out Christmas shopping with her two young sons when an accident occurred. One of her sons was playing around with a Christmas tree, that made up part of the shop’s Christmas promotional display. As he was doing so, the tree became detached from its position in the display, and fell directly onto him, causing him to fall backwards onto the floor. He sustained cuts and scratches to his face, and also dislocated a finger in the accident. Ms Allen reported the incident to the shop’s staff, and it was duly recorded by the manager in their accident book. Ms Allen’s son was taken to hospital where doctors realigned the bones in his finger and applied a protective splint. They also cleaned and dressed his facial wounds before discharging him.

Ms Allen was so upset by the whole incident that she decided to seek legal advice, and on the recommendation of a work colleague, contacted Bartletts Solicitors. We won an admission of liability from the shop’s insurers, and Ms Allen’s son was awarded £3,500 in compensation, to be held in trust for him by the court until he reaches the age of 18.
