Can I Claim Against British Coal For Hearing Loss? Yes
Case Study - Mr Jones
Mr Jones worked for the National Coal Board (later British Coal) for 15 years in the 1970’s and 1980’s. Normally he was deployed at the coal face, and was responsible for maintenance of the shearer (power loader), a heavy piece a machinery that regularly emitted noise levels of over 100 decibels. 10 years after leaving his job, Mr Jones began to experience ringing in his ears. He was subsequently diagnosed by his doctor as suffering from Noise Induced Hearing Loss (NIHL), a condition that was obviously related to noise levels he had been subjected to when employed as a miner. Mr Jones is now completely deaf in one ear, still experiences tinnitus (ringing in the ears), and has trouble following normal conversations.
Our Legal Advice
Mr Jones got in touch with Bartletts Solicitors having read about our previous success in claiming compensation for former coal miners for hearing loss caused by their previous working conditions. Since the Noise at Work Act 1989 was introduced cases such as that of Mr Jones have become rare. However, many former miners continue to gain compensation for industrial deafness each year, as a personal injury claim is valid within 3 years of the date of knowledge or diagnosis of work related hearing loss. Industrial deafness is in fact the most common occupational illness among former British coal workers. Bartletts negotiated successfully with the Department of Trade and Industry (DTI) on behalf of Mr Jones, who ultimately received a total of £22,000 of his work related hearing loss.
