Asthma Compensation Awards


Compensation awards for work related asthma depends on the severity of the condition and its ongoing consequences. Where asthma is severe, permanently disabling, impairs lifestyle and grossly restricts employment prospects, compensation awards will range from £27,500 to £42,000. Chronic asthma will involve periodic use of an inhaler and restricted employment prospects. Awards in this category will be between £16,750 and £27,500. Where asthma affects both work and social life, but a full recovery is likely within a few years, awards will range from £12,250 to £16,750. Relatively mild symptoms following exposure to a substance or vapour in the workplace will lead to compensation awards between £6,750 and £12,250. The least severe category is mild asthma or chest problems that resolves itself within a few months. The maximum asthma compensation award in this category will be £3,250.



Asthma Compensation Case Study 1


SITUATION: Mr Brown worked for his employer in the electrical industry for over 20 years and had developed asthma as a result of being exposed to solder flux fumes. Mr Brown had difficulty in walking for any distance without becoming breathless and he would require the use of inhalers for the rest of his life. He was also unable to work in an environment where he would be exposed to certain substances.

RESULT: Mr Brown was awarded £38,000 damages for the asthma that was caused by his work and even more for his future loss of earnings. Bartletts acted for Mr Brown on a No Win No Fee Basis. Bartletts instructed a medical expert who specialises in lung conditions (at no cost to Mr Brown) to provide a report on Mr Brown's condition after an appointment in Mr Brown's local area. Mr Brown received 100% of the compensation due to him.



Asthma Compensation Case Study 2


SITUATION: Ms Stevens worked at a small bakery in Northern England where she worked with flour on a daily basis. Though she had no history of asthma or other breathing difficulties, and was a non-smoker, she soon found herself short of breath during her walk to and from work. She also developed a cough whilst at work. Ms Stevens ignored the symptoms initially, as they did not persist outside the workplace, but eventually went to her GP for a check up. Here GP referred her to a respiratory specialist who swiftly diagnosed an allergy to flour dust, and that her lungs had most likely become sensitised to the substance during the course of her employment.

RESULT: Ms Stevens decided to claim against employer for asthma. She contacted our lawyers and asked; can I sue my employer for asthma caused by my work environment? We considered the facts of her case and said yes she could. Despite her employers being aware of the fact that flour dust is a respiratory sensitizer, no risk assessment had been undertaken or appropriate protective equipment provided. Health checks had also not been offered to employees at the bakery. Ms Stevens' employers accepted liability, and she was awarded £2,650 in damages.
