Case Study: Slip On Wet Floor In Toilets
Situation: Mr Hussain was visiting the toilet facilities at his local Asda store. While attempting to exit one of the cubicles he slipped on the wet floor, which had recently been cleaned, and fell backwards, banging his head against the toilet unit. Mr Hussain had a large bruise on his head, and complained of pain and dizziness. His wife reported the accident to the supermarket's management, who duly recorded the incident in their accident book, but failed to apologize or offer any form of recompense. The same day Mr Hussain saw his local GP, who diagnosed concussion and advised Mr Hussain to take the rest of the week off work, which he duly did.
Result: Mr Hussain subsequently got in touch with our company of solicitors and asked; how can I claim compensation from Asda supermarket? Asda is a big company and so I do not know if I am able to sue Asda? We explained that with our No Win No Fee agreement he could do so at no cost or risk to himself. He decided to sue Asda for his personal injuries. We argued that Asda had breached the duty of care that they owed to our client under the Occupiers Liability Act 1957. The Asda cleaning staff had failed to adequately dry the recently cleaned floor area, and no warning barriers or signs had been erected to prevent customers from accessing the affected area. The case was settled out of court, and Mr Hussain received £4,000 compensation for his injury, as well as a further sum for the working days he was forced to miss and other expenses. Our fees were paid by the supermarket's insurance company, and Mr Hussain kept 100% of the damages he was awarded.
Case Study: Trip On Packaging Materials In Aisle
Situation: Ms Johnson was walking down an aisle at her local Asda supermarket, when she tripped and fell heavily, breaking the impact of the fall by extending her arms. She had been looking at products on the shelves, and had failed to observe some cardboard packaging materials which had been left on the floor by a member of the supermarket's staff. Ms Johnson's sister was with her and reported the accident to the supermarket's management, as well as taking the details of witnesses to the accident. Ms Johnson attended A&E at a nearby hospital, where doctors found that one of her wrists was fractured, and required a plaster cast. Ms Johnson worked in a bakery, and as she was unable to perform her normal duties she did not return to work for over three weeks.
Result: Ms Johnson contacted our lawyers and asked; how can I sue Asda for my injuries? We advised her that she could do so under a No Win No Fee agreement as the staff should not have discarded packaging materials in aisles where they would pose an inevitable danger to shoppers. Asda had therefore negligently failed in its duty of care to take all reasonable measures to protect the health of visitors to their premises. We wrote to Asda's insurers detailing the situation, and including both a medical report and witness statements. Asda admitted liability for the accident relatively quickly, and Ms Johnson received £4,250 in damages, as well as a further £2,750 for the cost of medical treatment, including ongoing physiotherapy, and loss of earnings. As we handled the case on a No Win No Fee basis, Ms Johnson kept 100% of the damages, and our fees were met by Asda's insurers.
