Asbestosis Compensation Awards
Mesothelioma is the most serious type of asbestos-related disease, and usually proves fatal within months of diagnosis. The duration and pain and suffering will determine the exact amount of compensation, which will be between £52,500 and £81,500. For cases of lung cancer which are related to asbestos exposure, awards will vary between £50,000 and £64,250. Asbestosis may be hard to detect in its early stages, but quickly progresses to cause severe breathlessness. Asbestosis compensation awards will be between £30,750 and £67,500, depending on the percentage of respiratory difficulty in the injured person. Pleural thickening is usually an early sign of serious respiratory disability. Awards in this area will be between £24,500 and £50,000. Provisional awards of between £4,250 and £7,000 will also be made where there is no risk of mesothelioma, lung cancer or asbestosis developing.
Asbestosis Compensation Case Study
SITUATION: Mr Morrison worked at
a famous Northern shipyard throughout the
1960's. Asbestos was used as a matter of course in a variety of tasks
in the yard, and Mr Morrison himself used it regularly while
installing thermal insulation in ships. Asbestos was particularly used
to insulate boilers, pipes and as a fire retardant. The use of
asbestos in those days was completely unregulated; no protective masks
were provided or training as to the risks. Mr Morrison recalled that
clouds of asbestos dust were often present in his working environment,
but that 'nobody paid it any mind'.
RESULT: Mr Morrison began to experience
breathing difficulties in 2008, which
he and his wife at first attributed to his life-long smoking habit,
and the natural effects of ageing. As the symptoms got worse however
he decided to consult his GP, who referred him to a respiratory
specialist. After a series of tests Mr Morrison was diagnosed with
asbestosis, and was informed that was unlikely to live more than 5
years. Mr Morrison and his wife got in touch with Bartletts
Solicitors, who were able to identify the shipyard contractor's
insurance company for the period of his employment. In an out of court
settlement Mr Morrison was awarded over £40,000 in
compensation, and
his legal fees were paid by the insurance company.
